1. Agreement to these terms

These Terms of Service govern your use of the Wesprs apps and this website at wesprs.com. Wesprs is operated by Digital Services LLC. By creating an account or using the service, you agree to these terms and to our Privacy Policy. If you do not agree, do not use Wesprs.

Wesprs is a privacy-first, ephemeral dating service: you are verified to be a human adult, you remain anonymous, and your content expires server-side within 24 hours. These terms reflect that design and the honest limits of what software can guarantee.

2. You must be 18 or older

Wesprs is for adults only. You must be at least 18 years old to create an account or use the service. We verify this with an age-estimation and liveness check before you gain access, and we retain no biometric data from it (see the Privacy Policy).

If we learn that an account belongs to someone under 18, we will close it and delete the associated data, and we will follow the applicable child-safety reporting obligations. Misrepresenting your age is a breach of these terms.

3. Your account and authentication

You access Wesprs with a passkey, a phone number hashed through a privacy relay, or a pseudonymous recovery phrase — never a legal name, email-as-identity, or social login. You are responsible for keeping your credential and recovery phrase secure.

Because we hold no identifying account information and your recovery phrase is known only to you, we cannot recover your account if you lose your credential. This is a deliberate consequence of the anonymity design, not an oversight.

4. The single subscription and billing

Wesprs offers one privacy subscription (and, later, a Constellation tier). Core conversation is free for the 24-hour life of an exchange; the subscription adds capabilities described in the app at the point of purchase.

Subscriptions are billed in advance and renew automatically for the same period unless you cancel before the renewal date. On the web we bill through Stripe; in the apps, billing and renewals are handled by Apple In-App Purchase or Google Play Billing under their terms. We will show the price and renewal terms clearly before you buy, and the billing descriptor will identify Wesprs.

5. Price changes, cancellation, and refunds

We may change subscription prices. Any change applies only to future billing periods, and we will give you advance notice with the chance to cancel before it takes effect.

You can cancel at any time; cancellation stops the next renewal and you keep access until the end of the period you have paid for. Refunds are governed by the applicable consumer-protection law of your country and, for in-app purchases, by Apple's and Google's refund policies; where the law gives you a withdrawal or refund right, we honour it. We do not otherwise provide pro-rated refunds for a partial period.

6. Acceptable use and prohibited conduct

You agree not to use Wesprs to: harass, threaten, stalk, or abuse anyone; share, solicit, or threaten to share non-consensual intimate imagery; produce, share, or solicit child sexual abuse material or any sexual content involving minors; impersonate another person or misrepresent who you are; coerce, blackmail, or pressure anyone, on or off the platform; engage in sex trafficking, commercial sexual solicitation, or facilitate any of the above; share another person's private information without consent; or scrape, crawl, harvest, or otherwise collect data about other users by automated means.

You also agree not to circumvent the verification, ephemerality, or safety systems, including by re-registering to evade a ban. We enforce these rules; serious or repeated breaches result in removal.

7. Image consent and conduct in conversations

Only share images you have the right to share and that depict consensual, adult content. Do not send sexual or intimate images to anyone who has not agreed to receive them. Images are screened against known-illegal-content hash systems, have their metadata stripped server-side, and expire like all other content.

What you say and send to another person is between you under end-to-end encryption — we cannot read it — but that does not exempt your conduct from these terms or from the law. Reported misconduct is handled through our Trust & Safety process.

8. Reporting, enforcement, and counter-investigation

You can report misconduct from within the app, and anyone — including non-account-holders — can report intimate-image abuse at wesprs.com/ncii-intake. Filing a report preserves the minimal evidence needed to act, even after content expires (see the Privacy Policy, Section 6).

We review reports on their merits. We do not auto-ban based purely on the volume of reports against an account; mass-reporting is itself investigated, so coordinated false reporting will not silence a targeted user. We may warn, suspend, or permanently remove accounts that breach these terms, and we cooperate with lawful requests and mandatory-reporting duties.

9. Content and intellectual property

You keep ownership of the content you create. By sharing it on Wesprs you grant us a limited, non-exclusive licence to host, transmit, and display it solely to operate the service for the brief period it exists. Because content expires within 24 hours, this licence is correspondingly short-lived.

The Wesprs name, logo, software, and the look and feel of the apps and this website are our property or our licensors' and are protected by intellectual-property law. You may not copy, modify, or redistribute them except as the law expressly permits.

10. Intimate-image-abuse and child-safety takedowns

We act on valid intimate-image-abuse takedown requests, ordinarily within 48 hours, whether or not the requester has an account. We screen for and report apparent child sexual abuse material to the appropriate authority and preserve evidence as required by law.

11. Honest limits — what we do and do not promise

We describe Wesprs by its architecture, not by marketing absolutes. We do not claim a "% match", an AI compatibility score, or that we can find you a particular person. We do not make therapeutic or medical claims.

Ephemerality and coarse-location are real protections enforced in our systems, but no online service can guarantee that another person will not screenshot, photograph, or remember what you share, or that any system is perfectly secure. Treat anything you send to another human as something they could keep.

12. Feedback and third-party links

If you send us feedback or suggestions, you grant us the right to use them without obligation or compensation to you. The service may contain links to third-party sites or services that we do not control and are not responsible for; their terms and privacy practices are their own.

13. Disclaimer of warranties

Wesprs is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties not expressly stated here, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that it will lead to any particular outcome. Nothing in this section limits rights that applicable consumer law gives you and that cannot be waived.

14. Limitation of liability

To the fullest extent permitted by law, Wesprs and its team will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the service. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim or one hundred euros (€100). Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, fraud, or your non-waivable statutory consumer rights.

15. Termination

You may stop using Wesprs and delete your account at any time from within the app. We may suspend or terminate your access if you breach these terms, if we are required to by law, or to protect users or the service. On termination, your right to use the service ends; your content expires as normal, and only the abuse-report carve-out described in the Privacy Policy may persist.

16. Governing law and jurisdiction

These terms are governed by the law of the European Union member state in which the Wesprs controlling entity is established (the specific jurisdiction is pending confirmation by counsel before launch), without prejudice to the mandatory consumer-protection rights of your country of residence in the EU or UK. Disputes are subject to the courts of that jurisdiction, again without prejudice to any non-waivable right to bring proceedings in your home courts.

17. Changes to the service and to these terms

We may change, suspend, or discontinue parts of the service. We may also update these terms as the service and the law evolve; for material changes we will give notice at least 14 days before they take effect, keep a change log, and keep prior versions accessible. Continuing to use Wesprs after a change takes effect means you accept the updated terms.

18. Waiver, severability, and the whole agreement

If we do not enforce a provision, that is not a waiver of our right to do so later. If any provision is found unenforceable, the rest remain in force and the unenforceable part is limited to the minimum extent necessary. These terms and the Privacy Policy are the entire agreement between you and us about the service and supersede any prior understanding.
